CV Writing Services reserves the right to change or update these Terms and Conditions at any time. Changes will be posted on the CV Writing Services website in the Affiliate Area.
1. Commencement and Termination
This Agreement shall come into force upon your acceptance as an Affiliate and shall remain in effect until terminated. By applying to become an Affiliate you confirm you have reached the legal age of majority (currently 18 years).
You are entitled to terminate this Agreement at any time. You must cease to use the service immediately upon the termination of this Agreement. You shall not be entitled to receive any Commission on any Referrals made after the termination date.
We are entitled to terminate this Agreement and/or suspend the Affiliate from our service at any time, giving reasonable notice where possible.
2. Commission Payments
Payment will be made to Affiliates no more than 8 weeks after the end of the month in which they have made a sale of any CV Writing Services product or service. No commission will be paid on Affiliate’s own purchases. Payments will be made as follows:
Affiliates in the UK that have a minimum balance of £25 (twenty-five pounds) in their account. Affiliates outside of the UK that have a minimum balance of £50 (fifty pounds) in their account. Amounts below these limits will be carried forward to following months.
3. Affiliate Fraud and Artificial Traffic
In the event of any Affiliate fraud, all transactions in the Affiliate's account will be reversed and the account terminated. In addition we may take action to recover any payments made before fraud has been detected. We also reserve the right to take legal or criminal action against any company or individual involved.
The Affiliate should not use any means of artificial traffic to gain sales commission, including but not limited to the alteration of fellow Affiliates' link codes or interception of click through traffic from the affiliate to CV Writing Services website. Any such activity will be considers to be fraud and dealt with as above.
4. Legal Status of Affiliates
The legal status of the Affiliate is that of independent principal. The Affiliate is responsible for the payment of all tax and national insurance payable on any payments made by CV Writing Services.
This Agreement does not in any way create a business partnership or relationship of employer and employee between the Affiliate and CV Writing Services.
5. Liability
CV Writing Services shall not be liable to the Affiliate for defects or interruptions in the service, system failure problems with any security system, viruses or other harmful software, loss caused by any third party tampering with the website or affiliate tracking system or other indirect or consequential loss however arising.
6. Liability Limits
The liability of CV Writing Services to the Affiliate is limited to the total amount of commission earned by the Affiliate.
7. Website Content and Approval
The Affiliate is solely responsible for his/her website and all its contents and shall ensure that they conform at all times to all applicable laws and regulations. In particular Affiliates should ensure their website is compliant with the laws of the United Kingdom and their own country of residence.
The Affiliate shall use the ID and link URL provided by CV Writing Services to link to the CV Writing Services website. In addition CV Writing Services may from time to time supply approved materials for use by Affiliates for the promotion of CV Writing Services.
8. SPAM
The use of unsolicited email (SPAM), irrelevant or automated posting to forums, blogs etc. or similar activity to promote CV Writing Services is expressly prohibited. Any complaints received by us of such activities by any Affiliate will result in immediate and automatic suspension of that Affiliate’s account pending investigation of the complaint and may result in permanent termination of the account.
9. Confidentiality
Each party shall hold confidential all information gathered from the other in the course of this relationship and shall not reveal, pass or communicate any such information to any third party for any purpose other than required by law.
10. Copyright / Intellectual Property
All copyrights, trademarks, intellectual property rights, or any other rights connected to the service or software necessary for the service are owned by CV Writing Services or the relevant software provider. The Affiliate does not acquire any intellectual property rights whatsoever under this Agreement other than to use links and other material specifically supplied by CV Writing Services for the sole purpose of promoting CV Writing Services products and services under the terms of this Agreement.
11. Affiliates Information
The Affiliate consents to the use by CV Writing Services of Affiliate information, (whether supplied by the Affiliate, derived from Affiliate usage statistics or otherwise), to contact the Affiliate, send newsletters and updates, improve the quality of the services supplied and for marketing purposes. Personal information will be kept private and secure and will not be sold, lent or otherwise transmitted to third parties for any purpose other than that required by law.
Affiliates are responsible for keeping their login details secure.
12. Indemnification
The Affiliate shall keep CV Writing Services or its successors indemnified against any claims for damages or other claims for compensation arising from the contents of the Affiliate's website, any behaviour by the Affiliate in his/her actions as an Affiliate or any incorrect information given by the Affiliate. The Affiliate shall also compensate CV Writing Services for any other damages or costs caused by the Affiliate's improper, negligent or unauthorised use of our service, any breach of this agreement or any technical problems or loss of data caused by the Affiliate on CV Writing Services website.
13. Applicable Law
This Agreement is subject to the laws of England and shall be subject to the jurisdiction of the English courts.
Any dispute arising out of this Agreement may be settled by any arbitration or mediation procedure to which the parties may agree in writing.
